An automatic meal break deduction is a timekeeping rule that subtracts a fixed unpaid meal period, commonly thirty minutes, from recorded hours.

The deduction needs no punch out and back in, so it replaces captured meal time with an assumption. Under federal rules, a bona fide meal period means the employee is fully relieved of duty, generally for thirty minutes or more. An interrupted meal is compensable timeCompensable time. Compensable time is time you must count as hours worked and pay, whether or not the work was scheduled or approved in advance.Click to open the term. A nurse who eats at the station or a driver who takes a call during lunch worked through a meal already subtracted. Several states add their own meal period timing, waiver, and premium pay rules.

What makes an automatic deduction defensible?

Automatic deductions are not prohibited outright under federal rules, but the deducted period must be a genuine meal period. Deduct only with a clear policy, supporting evidence, and a correction path in place. Daily attestation, where the employee confirms the break was taken and uninterrupted, turns a silent subtraction into a documented one. Employers with meal period premium rules in their states often require a punch instead.
